##This investment tackles the ways in which governance and policy need to change to better protect te taiao (the environment).##\r

At the moment, there are many core issues with regional and national governance and policies that fail to protect, and sometimes directly endanger, the wellbeing of our biodiversity and the integrity of our biosecurity system.\r
\r
The people closest to nature currently find it difficult to get their knowledge and values recognised. They are often not included or resourced to participate in strategic, local or national decisions that would make a difference to biological heritage. This is particularly the case for mana whenua who, as kaitiaki, are often involved with bioheritage protection and advocacy for the environment.\r
\r
The Adaptive Governance & Policy team aims to ‘break the mould’ and build new systems, policies and capability that will provide much greater protection to our bioheritage. This includes embracing Treaty relationships with Māori and investigating the many opportunities for the environment that can arise when government engages in co-design of policy and co-governance of natural resources. The team will study what does and doesn’t work in Aotearoa when it comes to redistributing authority, decision-making abilities and responsibility.\r

At the time of writing, many of the processes that have recently been put in place in Aotearoa New Zealand to make the Crown accountable for te Tiriti o Waitangi are at risk. It is within this context that we finalise this report exploring possible specific and concrete accountability mechanisms for the Crown and its Tiriti obligations. This context highlights the contradiction at the heart of democratic accountability in settler colonies. That is, Crowns/States claim near-exclusive rights to revenue raising and typically use that revenue to go towards resourcing accountability mechanisms, to the limited extent that they are resourced or put in place. There is growing respect for and recognition of te ao Mäori within Aotearoa’s environmental policy and management space. However, to ensure that Aotearoa can build a better future equitably a ‘tika transition’ must be realised, wherey iwi, hapü and Mäori (the rangatiratanga sphere) and the Crown (kawanatanga sphere) exist within distinct and equal political entities, with the rangatiratanga sphere leading and governing tikanga and mätauranga Mäori policy and legislation. We examine two prominent environmental issues – sea level rise and taonga species protection – facing iwi, hapü, Mäori and the Crown, exploring the barriers, solutions and positive steps towards a ‘tika transition’ in each area. We recommend that policy and legislation include stronger instruments for shared decision making and specific funding for iwi, hapü and mana whenua to strengthen the rangatiratanga sphere. This study explores possibilities for resourcing rangatiratanga, or Indigenous self-determination. We start by illustrating the role of taxation in erasing Indigenous sovereignty to first establish colonial authority, and then maintain this authority through an inequitable taxation system. We are motivated by emerging arguments around the importance for Indigenous practices and perspectives in governance, but without the proper resourcing to do so, Indigenous peoples rely on limited capacity and immeasurable amounts of unpaid labour. We thus explore how a colonial authority has resourced its authority, and erased Indigenous sovereignty, while exploring opportunities to resource Indigenous self-determination. This study merely scratches the surface of possibilities by mapping and mirroring sources of revenue generated by the Government of New Zealand and imagining how this revenue can either be shared through various means (incremental opportunities) or how Indigenous authorities can resource themselves through alternative means (progressive opportunities). In doing so we take the possibilities of a Te Tiriti-compliant taxation system seriously.\r

This thesis outlines the important roles that tikanga and care ethics have in the governance of our environment. Current governing practices and systems in Aotearoa are deeply intertwined with colonial histories and ideologies that can devalue care, tikanga and reciprocal relationships. However, as environmental threats increase globally and locally, new ways of relating to and governing our environments are necessary (IPBES 2019; Te Mana o Te Taiao 2020). Indigenous knowledge and legal concepts are pivotal to more holistic governance of the environment and in Aotearoa, this often includes tikanga Māori. This thesis explores the need to decolonise governance systems and ideologies of care to ensure better relationships with the environment and between Te Tiriti o Waitangi partners in Aotearoa. I argue a political ethic of care is needed within environmental governance to ensure that relationships are balanced, and power, privilege and history are not ignored or maintained in the process of transitioning environmental governance into a more relational and tikanga Māori informed system. I recommend a Political Ethic of Care Toolbox to be used in environmental policy and planning by decision-makers working in environmental governance.\r

This article explores some of the key features of co-governance, or shared decision making, between Māori and the Crown. Co-governance models create the conditions for making better decisions by sharing decision making with Māori where Māori communities have a distinctive interest. Such models are able to draw on the distinctive experiences, knowledge and expertise that Māori communities can bring. Shared decision making enhances the legitimacy and durability of decisions by giving effect to rights under te Tiriti o Waitangi. The article also identifies some key principles of effective co-governance and provides some brief examples where shared decision making is being implemented to illustrate the range of situations in which such models are applicable.\r
